California Consumer Privacy Act (“CCPA”) Privacy Policy

The following Policies are effective for the Cascade 365 Group of Companies, including Cascade Capital, LLC; Cascade Capital, LLC – Series A; Cascade Capital, LLC – Series D; Cascade Capital Funding, LLC (each hereinafter a “Cascade 365 Company”). Unless otherwise stated the policy shall apply to all listed companies.

Right to Know About Personal Information Collected, Disclosed, or Sold

California Consumers have a right to request that the Cascade 365 Company receiving the consumer’s request disclose to the consumer what personal information it collects, uses, discloses or sells. To submit a request for disclosure of this information, you may:

After your submission, the Cascade 365 Company to whom your request was made, will confirm receipt of your request within 10 days unless it provides a response within that timeframe. The Cascade 365 Company to whom your request was made will verify your identity by matching information you provide to your personal information it maintains. The Cascade 365 Company to whom your request was made will respond to your request within 45 days of receipt unless more time is necessary, in which case it will inform you.

Note: No Cascade 365 Company sells or will sell a consumers’ personal information except as allowed by law.

In the past 12 months, one or more Cascade 365 Company have collected the following categories of consumers’ personal information:

• Personal identifiers such as name, address, and email address. The Cascade 365 Company to whom your request is made receives this information from original creditors and others from whom Accounts are purchased, and service providers hired to provide location and collection services. The Cascade 365 Company to whom your request is made collects this information to service accounts and collect debts. It shares this information with service providers hired to provide collection services.

• Categories of information described in Section 1798.80(e) of the California Civil Code such as insurance policy information, bank account information, other financial information, medical information and health insurance information. The Cascade 365 Company to whom your request is made receives this information from original creditors and others from whom Accounts are purchased. The Cascade 365 Company to whom your request is made collects this information to service accounts and collect debts. It shares this information with service providers hired to provide collection services.

• Professional or employment related information, The Cascade 365 Company to whom your request is made receives this information from original creditors and others from whom Accounts are purchased, and vendors hired to provide location and collection services. The Cascade 365 Company to whom your request is made collect this information to service Accounts and collect debts. It shares this information with Service Providers hired to provide collection services.

• Other information about you that is linked to the personal information above. The Cascade 365 Company to whom your request is made receives this information from original creditors and others from whom accounts are purchased, and Service Providers hired to provide location and collection services. The Cascade 365 Company to whom your request is made collects this information to service accounts and collect debts. We share this information with Service Providers hired to provide collection services.

Note: The term “Account” or “Accounts” means an account receivable originated by other than one of Cascade 365 Group of Companies and which one of the Cascade 365 companies purchased the rights, title and interest to such account receivable.

Other than as allowed by law relating to the sale of Accounts to third parties that purchase the right, title and interest to Accounts sold by one of the Cascade 365 Companies, none of the Cascade 365 Companies have sold any personal information to third parties for the preceding 12 months. In the preceding 12 months, we have disclosed the following categories of personal information to third parties for a business purpose:

• Personal identifiers such as name, address, and email address.
• Categories of information described in Section 1798.80(e) of the California Civil Code.
• Professional or employment related information.
• Other information about you that is linked to the personal information above.

Right to Request Deletion of Personal Information

California Consumers have a right to request the deletion of personal information that any of the Cascade 365 Companies has collected from them and maintains. To submit a request for deletion of this information, you may:

After your submission the Cascade 365 Company to whom you send your request will verify your identity by matching information you provide to your personal information we maintain, and then provide you a response that it has honored your request or provide you a response which details the reasons why all or part of your request has been denied.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

California Consumers have a right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA.

Authorized Agent

California Consumers can designate an authorized agent to make a request under the CCPA on their behalf. To do so, you must provide written authorization to your authorized agent to make the request on your behalf, and the authorized agent must provide the Cascade 365 Company to whom your request is made with that written authorization. In addition, we will need you to verify your identity with the Cascade 365 Company to whom your request is made directly.
